ADA WARNING: Northern California FIs Hit with ADA Lawsuits

FTSI has learned that at least one credit union in Northern California has had a lawsuit filed against it for failing to meet the Americans with Disabilities compliance standards. These claims can result in fines of up to $5,000 per violation for something as simple as not displaying an ADA sticker on an ATM or having a damaged sticker.

FTSI recommends that you routinely inspect your ATMs to ensure that they are in compliance with all of the requirements mandated by Section 707 of the 2010 ADA Accessibility Standards which can be found here.

Your financial institution’s brand must be maintained for each and every customer interaction at every ATM which is why FTSI offers a Standards and Compliance program that establishes a consistent appearance by conducting a complete field audit and recommending repairs and/or painting of the exterior fascia, signage, and compliance for all ADA and network requirements.

FTSI will continue to keep its customers and partners informed about this and all other possible threats to financial institutions and work to provide you with the resources to address them.

PLEASE NOTE: FTSI does not assume and does not have any liability for violations of ADA requirements or Unruh statutes. We strongly recommend your risk management implement protocols and procedures to ensure compliance with ADA requirements. Our Standards and Compliance service is designed to assist your financial institution in mitigation of potential violations and report areas out of compliance with recommended solutions.
